有鑑於印度青少年犯下重罪，特別是性侵罪有增加趨勢，印度決定修法提高刑責，未來觸犯輪暴與謀殺的少年犯將不受少年法保護。

根據《印度時報》（The Times of India）報導，印度青少年犯下性侵罪的比例有日增趨勢，近期重大案件包括:2012年12月16日德里巴士輪暴案1名未成年犯日前遭判刑3年，並發交矯正機構執行；2013年8月22日孟買女實習攝影記者輪暴案中，也有1名17歲少年遭起訴；2013年9月15日，阿薩姆省第1大城古瓦哈蒂（Guwahati）發生12歲女孩遭5名12至16歲未成年被告輪暴案，這些案件受全印度關注。

由於印度《少年司法》（Juvenile Justice Act）規定，未成年強暴犯若遭定罪，最高只能判3年徒刑，並在矯正機構執行，使得無法嚇阻青少年犯罪。

有鑑於印度青少年犯下重罪，特別是性侵罪有增加趨勢，印度各界呼籲加重刑期，印度婦女與兒童發展部在諮詢專家意見後，決定修法方向：犯下諸如輪暴或謀殺等重大案件的16到18歲嫌犯，將不受上述《少年司法》保護，而將依刑法受審。

報導也以英、美國家為例，在美國，約20個州將觸犯重罪少年視為成人審訊；英國17歲以下少年犯下性侵等罪行，受審時也會被視為成人審訊。
