4大超商咖啡漲價挨罰案　公平會再敗訴

【劉昌松／台北報導】統一、全家、萊爾富、OK等4大連鎖超商，前年因分別調漲現煮含乳咖啡價格，被公平會認定聯合漲價，共開罰2000萬元，4家超商去年打行政官司抗罰勝訴後，被最高行政法院撤銷發回，但台北高等行政法院今天更審宣判，仍判4家超商全部免罰，還可上訴。

4大超商前年10月間分別將現煮咖啡的價格調漲5元，公平會認為，4大超商的現煮咖啡屬於寡佔市場，卻一起漲價5元，超過鮮乳漲幅，影響消費者權益，因此開罰4家業者各50萬元到1600萬元。

台北高等行政法院去年首度審理時，認為當時媒體報導鮮乳漲價，咖啡可能因此漲價，全家便利商店在消費者預期中，率先漲價，其他業者是在得知後，才迅速應對，並無證據顯示各家是說好的齊漲。

此外台灣現煮咖啡市場，確實有5元級距的定價習慣，漲價金額符合「習慣性定價」理論等理由，判公平會敗訴。最高法行政法院發回更審後，台北高等行政法院今天再次判決4大超商「全部勝訴」。
