車禍撞腦　保險公司拒賠勝訴

【孫英哲／彰化報導】彰化縣一名蔡姓男子於1996年向新光人壽投保保額一百萬元終身壽險、保額500萬元的意外險附約、保額60萬元的綜合保障附約。

2010年9月間，蔡男騎機車行經永靖鄉時發生車禍，因頭部受創，導致蜘蛛網膜下腔出血而住院8天，之後因腦部損傷出現初老年期癡呆症合併憂鬱症等狀況。蔡男以因車禍造成自身傷害，要求新光人壽依保險合約給付448萬元的意外殘廢保險金。

新光人壽以蔡男投保的是傷害保險，必須因意外傷害才可獲理賠，然蔡男患有愛滋病，才導致失智，以及蔡男吸毒服藥後騎機車上路，不符合理賠規定，因此拒絕給付保險金。

蔡男提起民事訴訟，彰化地院審結全案，承訴蔡男之訴。

法官認為，本案理賠與否的關鍵在於蔡男是否因車禍造成失智症，該院委請台中榮總進行鑑定，沒有證據顯示蔡男的智力功能較車禍前明顯降低，無法認定蔡男罹患失智症，既然蔡男沒有失智症，保險公司也無須予以理賠，故將蔡男之訴駁回。
